Abavia offers a Notice & Takedown procedure. Below we describe the procedures as applicable under:
The Digital Services Act (DSA) for the EU
and/or
Digital Millennium Copyright Act (DMCA) for the US.
Since 2022 the Digital Services Act (Regulation (EU) 2022/2065; “DSA”) provides regulations concerning the storage, making available, and dissemination of online content. Any person or entity that believes that content posted by a user on Abavia’s Usenet servers is illegal, may submit a DSA Notice to our designated DSA Agent.
The DSA Notice has to contain following information:
a sufficiently substantiated explanation of the reasons why the notifier alleges the information in question to be illegal content;
a clear indication of the exact electronic location of that information, such as the message ID, and, where necessary, additional information enabling the identification of the illegal content adapted to the type of content and to the specific type of hosting service (Usenet);
the name and email address of the individual or entity submitting the notice, except in the case of a suspicion of an offence referred to in Articles 3 to 7 of Directive 2011/93/EU;
a statement confirming the bona fide belief of the notifier that the information and allegations contained in the notice are accurate and complete.

The Digital Millennium Copyright Act Since 1998 the DMCA (Digital Millennium Copyright Act) provides regulations concerning copyright infringements by electronic means. Copyright owners or their agents may submit a Notification of Claimed Infringement under the DMCA ("Notice") to our designated Copyright Agent if they believe they have found material that infringes on their copyrights.
The written Notice has to contain following information:
Information of the copyrighted work claimed to have been infringed or, in case of a single Notice with multiple works, a representative list of such works.
Precise identification of the material that is claimed to be infringing and sufficient information to enable Abavia S.r.l. to locate the material, such as each article's subject, date, time, message-ID(s), newsgroup posted.
Full contact information such as full name of the complaining party, address, telephone number, e-mail address and, for agents, a clear statement of the relationship to the owner of the copyrights.
A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
A clear statement, under penalty of law, that the information in the DMCA Notice is both accurate and that you are an authorized agent of an entity or the person who holds the copyright. A physical or electronic signature of the authorized agent of an entity or the person is also required. Please send your written Notice to our Designated Copyright Agent. In case your Notice does not fully comply with above mentioned standards, please do understand that processing or answering the Notice may not be possible. Upon receipt of a compliant Notice Abavia S.r.l. will take the following measures:
Eliminating the claimed copyright infringements.
Notifying the subscriber that material has been removed or disabled.
